By accessing or using www.aaronottcoaching.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use this Site. Use of the Site is offered conditioned on your acceptance of these Terms without modification.

2. About Aaron Ott Coaching

Aaron Ott Coaching is an executive coaching practice owned and operated by Aaron Ott, based in Nebraska, USA. Coaching services are provided exclusively to clients in the United States.

3. Site Use and Permitted Conduct

This Site is provided for informational purposes and to facilitate connection with coaching services. You agree to use this Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Reproduce, duplicate, or exploit any portion of the Site for commercial purposes without our written permission

  • Attempt to gain unauthorized access to any portion of the Site or its related systems

  • Transmit any harmful, offensive, or disruptive content through the Site

  • Use automated tools to scrape, crawl, or harvest data from the Site

4. Intellectual Property

All content on this Site, including text, graphics, logos, images, assessments, and downloadable resources, is the property of Aaron Ott Coaching or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws. Nothing on this Site grants you a license to use any of our intellectual property without our prior written consent.

5. Coaching Services and Agreements

All coaching engagements are governed by a Master Services Agreement (MSA) and a Statement of Work (SOW), which are separate documents provided to and executed by each client. The MSA is available at www.aaronottcoaching.com/msa. These Terms govern your use of this website only and do not supersede or modify the terms of any executed MSA or SOW.

Executive coaching is a professional development service. It is not therapy, counseling, legal advice, financial advice, or medical care. Coaching does not diagnose, treat, or cure any mental health condition. If you require such services, please seek a qualified licensed professional.

6. Scheduling and Payments

Appointment scheduling is managed through Calendly. Payment for services is processed through Stripe. By scheduling and paying for services, you agree to the applicable terms and policies of those platforms in addition to any payment or cancellation terms set forth in your Master Services Agreement and Statement of Work.

7. Session Recording and AI Tools

As permitted under Nebraska law (Neb. Rev. Stat. §86-290), coaching sessions may be recorded. Recording or AI-assisted transcription tools may be active during sessions. Coach will inform clients when such tools are in use. Recorded materials are treated as confidential in accordance with your Master Services Agreement. By executing an SOW, clients consent to recording and AI-assisted processing; clients may verbally opt out of recording during any individual session. 8. Cookies and Tracking Technologies

This Site uses cookies and similar tracking technologies, including Google Analytics and the Facebook (Meta) Conversion Pixel, to understand website traffic and the effectiveness of our marketing efforts. A cookie consent notice is displayed upon your first visit to the Site. You may manage or withdraw cookie consent at any time through your browser settings or the Site’s cookie preferences. AARON OTT COACHING DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Results from executive coaching are not guaranteed. Client outcomes depend on many variables including the client’s own effort, engagement, and circumstances.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AARON OTT COACHING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THIS SITE. LIABILITY FOR CLAIMS ARISING FROM A COACHING ENGAGEMENT IS GOVERNED EXCLUSIVELY BY YOUR EXECUTED MASTER SERVICES AGREEMENT AND STATEMENT OF WORK, UNDER WHICH TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY CLIENT UNDER THE APPLICABLE STATEMENT OF WORK.

12. Indemnification

You agree to indemnify, defend, and hold harmless Aaron Ott Coaching and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Site or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict of law principles. Any disputes arising under these Terms that cannot be resolved informally shall be submitted first to non-binding mediation, and if unresolved, to binding arbitration, each administered through the American Arbitration Association (AAA) or JAMS in Omaha, Nebraska or by remote proceeding, consistent with the dispute resolution terms set forth in the Master Services Agreement. Either party may seek emergency injunctive relief from a court of competent jurisdiction in Douglas County, Nebraska where necessary to prevent irreparable harm.

14. Data Retention & Deletion

Client records and related coaching materials are retained for a minimum of three (3) years following the end of an engagement, in accordance with our Privacy Policy. After the applicable minimum retention period, data will be permanently deleted using each platform’s native deletion functions. 15. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Active clients will be notified by email at least 7 days before material changes take effect. Changes will be posted on this page with an updated "Last Updated" date and version number. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
